Lively v. Baldoni et al

Complaint allegedly filed (according to Blake's team) with the California Civil Rights Department & not filed in State or Federal Court.

Important FACTS:

  1. This complaint is not a civil lawsuit. It was not filed in either a state or federal court.

    If it was, the complaint would have stated on the first page which court it was filed in.

  2. This complaint was allegedly filed with the California Civil Rights Department, which initiates a review process. These complaints are not searchable to the public, which mean Blake Lively's team had to have leaked this to the press giving an exclusive to the New York Times in which they hid the complaint behind a paid firewall to extract money in new subscriptions using the bad PR (I subscribed for $4 to download and provide the complaint for free to the public).

Obtain a Right to Sue

From the Civil Rights Department of the State of California:

You may file your own lawsuit for employment discrimination in court rather than using the CRD investigation process. This is advisable only if you have an attorney. Also note that if you receive a right-to-sue notice, your complaint will not be investigated by CRD even if you later decide not to file a lawsuit.

So why didn't Blake Lively just file a lawsuit against Sony Pictures? They were technically the "employers."

How did Blake Lively legally obtain the text messages cited in the California Civil Rights Department Complaint that was JUST filed on Friday, December 20th if there is no known pending civil court case anywhere?

Was Justin Baldoni actually compelled to release these messages? If so, what was the reason for compelling the messages and what court issued the subpoena?

Based on reports, it appears that the text messages were not compelled by a court, but were allegedly obtained illegally.
